“Bail not jail is the rule even in special statutes; if courts stop granting bail when case for it is made out then it violates Article 21 of accused” Supreme court of India observed today.
Supreme Court grants bail to man accused of being landlord to and aiding alleged PFI members who were plotting to establish Islamic rule in India.
Justice Abhay S Oka told, When the case is made out for grant of bail, courts should not have any hesitation in granting bail. The allegations of the prosecution may be very serious, but the duty of the court is to consider the case in accordance with law. If courts start denying bail even in deserving cases, then it is a violation of fundamental rights under Article 21. So we have granted bail.
